Road bully in Toyota Alphard pleads not guilty to reckless driving and driving on emergency lane 01

The driver of the Toyota Alphard that was seen provoking other road users along the Karak Highway was charged with three counts in the Magistrate’s Court today (21-June-2022). However, the driver only pleaded guilty to one charge.

According to Harian Metro, the first count read to the accused, Lim Koh Ching, 44, was charged under Section 42 (1) of the Road Transport Act 1987 (Act 333) for reckless and dangerous driving at 3.47 pm on 30-April-2022 at KM 27.5 of the Karak Highway heading towards Bentong.

If he was found guilty, the restaurant owner will face a jail term of up to five years and a fine not less than RM 5,000 and not exceeding RM 15,000. Lim will also have his driving licence confiscated for not more than five years from the date of conviction.

For the second count, Lim was charged with committing public harm by spitting through the driver’s window on the same day, place, and location. If found guilty, he will be charged under Section 290 of the Penal Code which carries a maximum fine of RM 400.

For the third count, Lim was charged under Rule 53 (1) Traffic 1959 (LN166/59) for driving on an emergency lane.

If found guilty, Lim can be penalised under Section 119 (2) of the Road Transport Act 1987. He will face a fine not exceeding RM 2,000 or imprisonment for a maximum of six months.

Out of three counts, Lim only pleaded guilty to the second count and the court imposed a fine of RM 400 or a month in jail if he fails to pay the fine.

As for the first and third counts, Lim pleaded not guilty and will file an appeal.

The Deputy Public Prosecutor, Anis Farhah Abdul Hilmi, proposed a bail of RM 7,000. However, Lim, who was not represented by a lawyer, pleaded to have the bail amount reduced because he has a family to support.

Magistrate Nur Haifzah Rajuni then reduced the bail to RM 5,000 with one surety and set 5-September-2022 for the re-mention of the case.

Back in May, the video of Lim’s white Toyota Alphard driving dangerously and provoking other road users went viral prompting the Royal Malaysia Police to carry out an investigation. Lim was immediately detained and remanded for three days and released on bail.
